These terms of use apply to the Audely apps and website. By downloading, accessing, or using Audely, you agree to these terms. If you do not agree, do not use Audely.
App licence
Audely is licensed, not sold. Your use of the app is also governed by Apple’s Standard EULA. Mandatory consumer rights continue to apply.
Your audio and library
You keep ownership of the audio, artwork, notes, and other content you use with Audely. You are responsible for having permission to use that content and for following applicable law.
Your audio files are never sent to Audely. Audely reads them in place and stores library changes separately. Removing or resetting Audely data does not delete the original files. If you choose an iCloud Drive folder, iCloud Drive may move those files between your devices under your Apple Account. That happens independently of Audely.
iCloud features
Sync and cloud backups are optional Audely Pro features that store library information in your private iCloud account. Audio files and folder access are never included. Each device still needs access to its own local or iCloud Drive audio.
Ordinary cloud-backup creation keeps up to five recent recovery points. A restore may temporarily add an extra safety backup until the next ordinary verified backup. Restoring replaces the current Audely library information after confirmation and may require you to link folders again. Keep independent copies of anything you cannot afford to lose. These features depend on Apple’s services, your Apple Account, internet access, and available iCloud storage.
Transcription
Audely Pro is required for full podcast transcripts, podcast transcript search, podcast transcript generation, and model downloads. Generation happens on your device and never uploads your audio. Audiobooks are not transcribed.
Transcripts are generated automatically. The current model detects the spoken language and can generate text in 100 languages, but language availability does not mean equal accuracy. Quality may vary significantly with the language, accent, speaking pace, recording quality, background noise, overlapping speech, specialist vocabulary, and other characteristics of the recording. A transcript may omit, add, or incorrectly represent words.
Generated transcripts are provided for convenience. Check names, numbers, quotations, and other important information against the original recording. Do not rely on a transcript where an error could cause harm or loss, or use one as a substitute for professional transcription.
Audely Pro and purchases
Audely Pro is available as monthly and yearly auto-renewing subscriptions through Apple. The purchase screen shows the current price and any trial for which you are eligible. A trial becomes a paid subscription unless you cancel before it ends, and a paid subscription renews until cancelled.
Apple handles payment, renewal, cancellation, refunds, and offer eligibility. Manage the subscription in your Apple Account settings. One subscription covers supported Audely apps using the same Apple Account. Family Sharing is not offered.
When your Audely Pro subscription ends, your library, audio, transcripts, downloaded model, synced information, and cloud backups are not deleted. Pro features pause and your appearance choices return to Audely’s defaults. Subscribing again does not restore the previous appearance choices. You can still remove retained transcripts, the model, synced information, and backups.
Privacy
The Privacy policy explains how Audely handles local data, optional iCloud features, purchases, diagnostics, website requests, and support messages. Your use of Apple services is also subject to Apple’s terms and privacy policies.
Ownership and third-party software
Audely, its website, branding, and original materials are protected by applicable intellectual-property laws. Open-source components remain subject to their own licence notices in Audely’s Acknowledgements.
Acceptable use
Do not misuse Audely, interfere with its security, bypass purchase controls, infringe another person’s rights, or use the app or website unlawfully.
Availability and changes
We may change Audely to maintain or improve the product, security, compatibility, or legal compliance. We do not guarantee uninterrupted or error-free operation, including where Audely depends on Apple services. Paid subscriptions and consumer rights remain subject to Apple’s terms and applicable law.
Warranty and liability
To the maximum extent permitted by law, Audely is provided “as is” and “as available.” Nothing in these terms excludes rights or liability that cannot legally be excluded. Subject to those rights, we are not liable for indirect or consequential loss arising from Audely or unavailable third-party services. You remain responsible for independent copies of important files and information.
Law, disputes, and changes to these terms
Apple’s Standard EULA governs applicable law and disputes, subject to mandatory rights where you live. Contact [email protected] if you have a concern.
